On 24 February, the Special Electoral Jury (Jurado Electoral Especial, JEE) ruled Julio Guzman’s candidacy to the presidency acceptable. After prolonged legal wrangling and having provided him with only two days to present the relevant paperwork, he was finally allowed to run, albeit with some small amendments such as changing the colour of his organisation from purple to red.

The same day Guzmán was given the all clear, the National Electoral Jury (JNE) put out a resolution noting that Cesar Acuña lacked the ethical credentials to be a presidential candidate and was found as having violated the ethical electoral pact. This is not really a reason for him to be disqualified from the race, but his image has taken a huge toll and he has fallen sharply in the opinion polls to third place.

By contrast, polls show that Guzmán’s candidacy has continued to surge. The CPI poll, published on 26 February shows his voting preferences to have risen to 18.3%. This is, of course, well behind Keiko Fujimori who remains on 33.7%, but he has overtaken all other candidates. According to this poll, Cesar Acuña has fallen to 7.3% and Pedro Pablo Kaczynski to 6.8%, with Alan Garcia on 6.4%. Verónika Menodoza and Alfredo Barnechea are up to 4.1% and 3.8% respectively.

In spite of his poll surge and having received the green light from the JEE, Guzmán is still facing some further legal obstacles to his candidacy. The former judge Malzon Urbina, who was suspended from his post when in 2012 he supported the street traders against the municipality at La Parada Market in Lima, presented a petition to have Guzmán taken out of the race for administrative shortcomings. Although the JEE rules this out, other similar moves are in prospect. It is unclear what the consequences of these may be. The electoral law allows for much wrangling over formalities even if these lack much substance.
